Welcome to Crew Holidays (the "Agency"). The Agency acts solely to assist customers in gathering travel information, determining the availability of travel-related goods and services, making legitimate reservations, or otherwise transacting business with travel suppliers, and for no other purposes. The terms "we," "us," "our," “Agency,” and "Crew Holidays" refer to Moan Elite Tour FZC, a limited liability company incorporated in Ajman, United Arab Emirates. The term "you" refers to the customer visiting the Agency and/or booking a reservation through us, or through our customer service agents.

Services of the Agency are offered to you conditioned upon your acceptance without modification of all the terms, conditions, and notices set forth below (collectively, the "Agreement"). By using the services of the Agency in any manner, you agree to be bound by the Agreement. Please read the Agreement carefully. If you do not accept all of these terms and conditions, please do not use the services of the Agency.

Use of the Services

As a condition of your use of the services, you warrant that:

• You are at least 18 years of age.
• You possess the legal authority to create a binding legal obligation.
• You will use the services in accordance with this Agreement.
• You will only use the services to make legitimate purchases for yourself or for another person who is at least 18 years of age and for whom you are legally authorized to act.
• All information supplied by you to the Agency is true, accurate, current, and complete.

We retain the right, at our sole discretion, to deny access to the services to anyone at any time and for any reason, including, but not limited to, a violation of this Agreement.

Prohibited Activities

The services and information of the Agency (including, but not limited to, price and availability of travel services), as well as the infrastructure used to provide such content and information, is proprietary to us or our suppliers and providers. While you may make limited copies of your travel itinerary (and related documents) for travel or services booked through the Agency, you agree not to otherwise modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell or re-sell any information, software, products, or services obtained from or through the Agency. Additionally, you agree not to:

• Use the services of the Agency for any commercial purpose;
• Make any speculative, false, or fraudulent reservation or any reservation in anticipation of demand;
• Access, monitor, or copy any content or information of the Agency Website using any robot, spider, scraper, or other automated means or any manual process for any purpose without our express written permission;
• Violate the restrictions in any robot exclusion headers on the Agency Website or bypass or circumvent other measures employed to prevent or limit access to services;
• Take any action that imposes, or may impose, in our discretion, an unreasonable or disproportionately large load on our infrastructure;
• Deep-link to any portion of the Agency Website (including, without limitation, the purchase path for any travel services) for any purpose without our express written permission; or
• "Frame," "mirror," or otherwise incorporate any part of the Agency Website into any other website without our prior written authorization.

You understand that any violations of this clause may result in the cancellation of your reservation(s), your being denied access to the applicable travel product or services, your forfeiting any monies paid for such reservation(s), and/or our debiting your account for any costs we incur as a result of such violation.

Suppliers, Rules, and Restrictions

You acknowledge that the Agency pre-negotiates rates with suppliers to facilitate the purchase of products and services on your behalf. The rate displayed on the Agency offers or Website is a combination of the pre-negotiated rates for the products and services that you purchase and a fee retained by the Agency to compensate us for our services (if applicable).

All stated terms and conditions will apply to your reservation and purchase of travel-related goods and services that you select. Please read these terms and conditions carefully. You agree to abide by the terms and conditions of purchase imposed by any supplier with whom you elect to deal, including, but not limited to, payment of all amounts when due and compliance with the supplier's rules and restrictions regarding availability and use of fares, products, or services. You acknowledge that some third-party providers offering certain services and/or activities may require you to sign their liability waiver prior to participating in the service and/or activity they offer. You understand that any violation of any such supplier's rules and restrictions may result in cancellation of your reservation(s), your being denied access to the applicable travel product or services, your forfeiting any monies paid for such reservation(s), and/or our debiting your account for any costs we incur as a result of such violation.

You agree to inform the Agency of any circumstance or condition as a result of which you or any person on whose behalf you are making a reservation may require special facilities prior to your purchase. Any complaints regarding a supplier should be brought to the attention of the supplier immediately during the time of the service and the same should be communicated to us in writing within thirty days thereafter, failing which, the Agency will not entertain any such complaints.

Payment Policy

All requests for changes or cancellations of any goods and services purchased through the Agency must be delivered in writing to the Agency or by email to sales@crewholidays.com and must be received, in both cases, on our working days at least 24 hours before these goods and services are scheduled to be provided. Our office is open ("working days") from 10:00 AM to 6:00 PM United Arab Emirates local time on each day from Sunday to Thursday, except on public holidays and holidays declared for private sector establishments in the United Arab Emirates.

You agree to abide by the terms and conditions imposed at the time of your purchase, which will determine the change and cancellation policy applicable to your purchase, including, but not limited to, penalties which may apply. Additionally, you agree that:

1. If a change or cancellation policy relevant to your request is not provided in the terms and conditions imposed at the time of your purchase, your purchase cannot be changed and is non-refundable in the event of a cancellation.
2. If a cancellation policy relevant to your request in the terms and conditions imposed at the time of your purchase does not explicitly state a refundable amount or how it may be calculated, your purchase is non-refundable in the event of a cancellation.
3. If the change or cancellation policies relevant to your request in the terms and conditions imposed at the time of your purchase do not specify the price of partly utilized services, they will be calculated based on the price of the utilized services alone at the time of your request and not pro-rata.

Requests for permitted changes and cancellations will be processed within 2 working days after all payments required to process the request are settled. In the event of a cancellation, any payments to be refunded after the deduction of payments required to process the cancellation will be credited to the same payment card or account which was used to make the original purchase within 15 working days thereafter. Some payment cards and accounts may take up to an additional 30 days to display the credited amount.

Cancellation Refund Period

• All bookings and confirmed related services canceled within the period of 10–31 days (depending on the selected and booked resort) prior to arrival/beginning of service or more are subject to free-of-charge cancellation and will be fully refunded as per related charges. For detailed information on the cancellation policy, please refer to the specific type of resort on www.crewholidays.com.
• All bookings and confirmed related services canceled within the period of 30–9 days (depending on the selected and booked resort) prior to arrival/beginning of service or less or marked as "No Show" are subject to 100% cancellation charges. For detailed information on the cancellation policy, please refer to the specific type of resort on www.crewholidays.com.

Moan Elite Tour FZC or the resort does not take any responsibility for last-minute changes, delays, cancellations, or missed flights. We always recommend traveling on confirmed flight tickets.

Refund Amount %

• Bookings and confirmed related services canceled within the period of 10–31 days (depending on the selected and booked resort) prior to arrival/beginning of service or more will receive a 100% refund amount. For detailed information on the cancellation policy, please refer to the specific type of resort on www.crewholidays.com.
• Bookings and confirmed related services canceled within the period of 30–9 days (depending on the selected and booked resort) prior to arrival/beginning of service or less, or marked as No Show, are not eligible for a refund. For detailed information on the cancellation policy, please refer to the specific type of resort on www.crewholidays.com.

Delivery Policy

Moan Elite Tour FZC reserves the right to process or confirm any pending booking requests within 24 hours due to reservation department closure, out-of-office hours, weekends, or public holidays.

All goods and services purchased through the Agency and their transaction receipts will be delivered in the form of a printable voucher ("voucher") after the successful completion of your purchase.

We shall not be liable if you do not receive your voucher because the email address you provided at the time of purchase was unable to receive the email containing your voucher after your successful completion of the purchase or for up to twenty-four hours thereafter for any reason whatsoever.

We do not provide goods and services to countries, entities, and individuals barred by the Office of Foreign Assets Control ("OFAC") of the US Department of the Treasury in compliance with the laws of the United Arab Emirates.

Privacy Policy

We understand that making purchases online involves a great deal of trust on your part. We take this trust very seriously and make it our highest priority to ensure the security and confidentiality of the personal information you provide to us.

Prepaid Hotel Reservations

Your hotel vouchers do not include fees for facilities and services other than those explicitly included on your voucher, which may be charged directly at the hotel.

You acknowledge that the Agency pre-negotiates certain room rates with hotel suppliers to facilitate the booking of reservations on your behalf. The room rate displayed through the Agency includes, but is not limited to, the pre-negotiated room rate for rooms reserved on your behalf by the Agency and the facilitation fee retained by the Agency to compensate us for our services (if applicable). You authorize the Agency to book reservations for the total reservation price displayed through the Agency. You agree that your credit card will be charged by the Agency for the total reservation price. Upon submitting your reservation request, you authorize the Agency to facilitate hotel reservations on your behalf, including making payment arrangements with hotel suppliers.

You may cancel or change your prepaid hotel reservation, but you will be charged the cancellation or change fee indicated in the rules and restrictions for the hotel reservation. In addition, if you do not cancel or change your reservation before the cancellation policy period applicable to the hotel you reserved (which varies by hotel, usually 31 to 10 days prior to your date of arrival), you will be subject to a charge of applicable nightly rates, tax recovery charges, and service fees. In the event you do not show for the first night of the reservation and plan to check in for subsequent nights in your reservation, you must confirm the reservation changes with the Agency.

You agree to pay any cancellation or change fees that you incur. In limited cases, some hotels do not permit changes to or cancellations of reservations after they are made, as indicated in the rules and restrictions for the hotel reservation. You agree to abide by the terms and conditions imposed with respect to your prepaid hotel reservations.

Travel Destinations

Although most travel, including travel to international destinations, is completed without incident, travel to certain destinations may involve greater risk than others. The Agency urges passengers to review travel prohibitions, warnings, announcements, and advisories issued by the government prior to booking travel to international destinations.

By offering travel to particular international destinations for sale, the Agency does not represent or warrant that travel to such locations is advisable or without risk and is not liable for damages or losses that may result from travel to such destinations.

Liability Disclaimer

The information, software, products, and services published through the Agency may include inaccuracies or errors, including pricing errors. In particular, the Agency and its corporate affiliates (collectively, the "Agency companies") and the affiliated, co-branded, and/or linked website partners through whom we provide services (collectively, "Agency affiliates") do not guarantee the accuracy of, and disclaim all liability for, any errors or other inaccuracies relating to the information and description of hotels, air, cruise, car, and other travel products displayed on the website (including, without limitation, pricing, photographs, list of hotel amenities, general product descriptions, etc.), much of which is provided by the respective suppliers. Prices are not valid until purchased. Additionally, the Agency expressly reserves the right to correct any pricing errors in the offers and/or on pending reservations made under an incorrect price. In such cases, we will offer you the opportunity to retain your pending reservation at the correct price or, at your option, cancel the reservation without penalty.

You are fully responsible for ascertaining and obtaining the documents required for your entire trip, including, but not limited to, emigration letters, passports, and visas as necessary.

Hotel ratings displayed in the Agency's offers are intended as general guidelines only, and the Agency companies and the Agency affiliates do not guarantee the accuracy of these ratings. The Agency companies, the Agency affiliates, and their respective suppliers make no guarantees about the availability of specific products and services. The Agency companies, the Agency affiliates, and their respective suppliers may make improvements and/or changes to the offers at any time.

The Agency companies, the Agency affiliates, and their respective suppliers make no representations about the suitability of the information, software, products, and services contained in the offers for any purpose. The inclusion or offering of any products or services does not constitute an endorsement or recommendation of such products or services by the Agency companies or the Agency affiliates. All such information, software, products, and services are provided "as is" without warranty of any kind.

The carriers, hotels, and other suppliers providing travel or other services for the Agency are independent contractors and not agents or employees of the Agency. The Agency is not liable for the acts, errors, omissions, representations, warranties, breaches, or negligence of any such suppliers or for any personal injuries, death, property damage, or other damages or expenses resulting therefrom. The Agency has no liability and will make no refund in the event of any delay, cancellation, overbooking, strike, force majeure, or other causes beyond its direct control. The Agency also has no responsibility for any additional expense, omissions, delays, re-routing, or acts of any government or authority.

The limitation of liability reflects the allocation of risk between the parties. The limitations specified in this section will survive and apply even if any limited remedy specified in these terms is found to have failed in its essential purpose. The limitations of liability provided in these terms inure to the benefit of the Agency and/or its respective suppliers.

Indemnification

You agree to defend and indemnify the Agency, and/or its respective suppliers and any of their officers, directors, employees, and agents from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties, or other costs or expenses of any kind or nature, including but not limited to reasonable legal and accounting fees, brought by third parties as a result of:

• Your breach of this Agreement or the documents referenced herein;
• Your violation of any law or the rights of a third party.

General

The Agency is operated by Moan Elite Tour FZC, a limited liability company incorporated in the Emirate of Ajman, United Arab Emirates, and this Agreement is governed by the laws of the Emirate of Ajman, United Arab Emirates. You hereby consent to the exclusive jurisdiction and venue of courts in Ajman, United Arab Emirates, in all disputes arising out of or relating to the use of Agency services. Use of services is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including, without limitation, this paragraph.

You agree that no joint venture, partnership, or employment relationship exists between you and the Agency as a result of this Agreement or use of Agency services.

Our performance of this Agreement is subject to existing laws and legal processes, and nothing contained in this Agreement limits our right to comply with law enforcement or other governmental or legal requests or requirements relating to your use of Agency services or information provided to or gathered by us with respect to such use. To the extent allowed by applicable law, you agree that you will bring any claim or cause of action arising from or relating to your use of Agency services within two (2) years from the date on which such claim or action arose or accrued, or such claim or cause of action will be irrevocably waived.

If any part of this Agreement is determined to be invalid or unenforceable pursuant to applicable law, including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision, and the Agreement shall continue in effect.

This Agreement (and any other terms and conditions referenced herein) constitutes the entire agreement between you and the Agency with respect to Agency services and supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between the customer and the Agency. A printed version of this Agreement and any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this Agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
